1. Data Controller

Berky Accounting, led by Bernard Ngutu Kyuthi, CPA (K), with operations in Nairobi, Kenya, is the data controller responsible for personal data collected through this website and associated enquiry channels.

2. Personal Data We Collect

When you submit an enquiry, we may collect your full name, email address, telephone number, selected service category, and the brief explanation you provide. We may also collect technical data such as browser type and IP address through standard server logs.

3. Purpose of Processing

We process your personal data to respond to enquiries, evaluate service fit, schedule consultations, maintain client records, and comply with applicable legal and professional obligations.

4. Legal Basis

Processing is based on your consent when submitting the contact form, our legitimate interest in operating and growing the firm, and compliance with legal obligations under Kenyan law.

5. Data Retention

Enquiry records are retained for up to three (3) years unless a client relationship is established, in which case records are retained in accordance with professional, tax, and regulatory requirements. Server logs are retained for up to twelve (12) months.

6. Information Sharing

We do not sell personal data. Information may be shared with trusted service providers (such as email or hosting platforms) strictly for operational purposes, or where required by law, court order, or regulatory authority including the Office of the Data Protection Commissioner (ODPC).

7. Data Security

We implement appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction. However, no internet transmission is completely secure.

8. Your Rights Under the Data Protection Act, 2019

You have the right to access, rectify, erase, restrict processing, object to processing, and withdraw consent. You may also lodge a complaint with the Office of the Data Protection Commissioner if you believe your rights have been violated.

9. Confidential Documents

We recommend that you do not send confidential financial documents through the initial website contact form. Secure document exchange will be arranged through approved channels after engagement.
